The deadline to apply under the EU settlement scheme (EUSS) is 30 June 2021. For those EU Citizens and their family members who were in the UK exercising their free movement rights as of 11pm on 31 December 2021.

The application under the EU Settlement Scheme can be submitted online within the UK or outside of the UK. In most cases, using the EU Exit Document ID document check. There are no Home Office fees associated with this application.

The Applicant will either be eligible for settled or pre-settled status, this will depend on whether the applicant can prove their residence in the UK. EU/EEA citizens who have resided in the UK for a continuous period of 5 years with a minimum of 6 months of each year spent in the UK will be granted Settled Status also known as indefinite leave to remain. Applicants who have resided less than 5 years will be entitled to pre-settled status also known as limited leave to remain for up to 5 years and then they must apply for settled status to remain in the UK indefinitely.

The Home Office have stated for those who miss the 30 June 2021 deadline, late applications may be accepted at their discretion only if there are reasonable grounds for missing the deadline.

Once the deadline has passed, anyone with a pending valid EU Settlement Scheme application will have their rights protected until a decision is made on their status.
