Man receives £42,000 following a dumper truck accident at work
The claimant, a 59-year-old man, received £42,000 for the leg injuries he sustained following an accident at work in April 2016. He underwent surgery and was left with permanent pain, a limp and difficulty in kneeling.
On 7 April 2016 the claimant employee was working for the defendant employer (D) as a plant fitter and approached a dumper truck to carry out checks when D's apprentice caught the forward control lever of the truck. The truck subsequently ran over the man's foot and up his left leg.
As a result of the accident, the man sustained a closed fracture of the left tibia and fibula. Following the operation, he developed an infection and was readmitted to hospital where he underwent an exchange nailing of the intramedullary nail. He was administered intravenous antibiotics whilst he remained in hospital for eight days. He was then discharged and a district nurse continued to administer the intravenous antibiotics for a further month. The wound was re-dressed regularly for three months.
The man then experienced difficulty in kneeling and anterior pain, he walked with a limp and he was unable to walk long distances. Unfortunately, his condition was permanent. He was also considered to be at a permanent disadvantage on the open labour market.
The man instructed a specialist personal injury solicitor to pursue a claim for compensation. The man alleged that D was negligent in (i) failing to provide the man with a safe system of work; (ii) failing to carry out any adequate risk assessments; (iii) failing to fit a bracket or guard around the forward control lever; (iv) failing to provide for the man safe and competent fellow employees; (v) failing to minimise the number of employees working on the dumper truck at the time; (vi) exposing the man to a danger or a trap or a foreseeable risk of injury.
Liability was admitted and an out of Court settlement was agreed in the sum of £42,000.
