For those seeking legal aid in private family law matters, it is necessary to provide evidence of domestic abuse, unless the application relates to a non-molestation order or an occupation order.
Acceptable forms of evidence may include:
- A letter from a recognised domestic abuse support organisation
- A report or letter from a qualified healthcare professional
- A relevant criminal conviction or ongoing criminal proceedings related to domestic abuse
- Evidence of an arrest for a domestic abuse-related offence
- A formal plan indicating that a child is at risk of, or has experienced, harm caused by the opposing party
