Man receives £5,828 compensation following road traffic accident

The claimant, a 73-year-old man, received £5,828 for the exacerbation of a pre-existing neck injury he suffered following a road traffic accident in August 2016. He suffered pain every day which persisted at the raised level for 18 months.

On 2 August 2016, the claimant was travelling as a passenger along a Belgian motorway when their vehicle was hit by another whose driver was insured by the defendant. The defendant's driver was attempting to change lanes and in doing so collided with the passenger side of the claimant’s vehicle.

Prior to the index accident the man had experienced pain approximately every four days from a pre-existing neck injury. As a result of the accident, the man suffered an exacerbation of this injury and suffered pain on a daily basis for 18 months. He was prescribed medication to ease his symptoms and underwent physiotherapy.

The man instructed a specialist personal injury solicitor to pursue a claim for compensation. The man alleged that the defendant's driver was negligent in failing to drive safely by attempting to change lanes when it was unsafe to do so.

Liability was admitted and an out of court settlement was agreed in the sum of £5,828.
