Woman receives compensation following an injury during exercise class

The claimant, a 28-year-old woman, received £3,695 after her foot went through a wooden floor whilst she was giving an exercise class during her work as a personal trainer and gym instructor in January 2015. She sustained soft tissue injuries which resolved by three months after the accident.

On 30 January 2015, the woman was working as a personal trainer and gym instructor for the defendant employer (D). She was coaching a high-intensity exercise class, which involved fast movements and jumps from steppers whilst holding a 5kg weight plate, when her right foot went through part of the wooden studio floor.

As a result of the accident, the woman sustained soft tissue injuries to both knees and the left ankle. She was off work for two months as she required the use of crutches due to her injury. She was also unable to cope with higher impact aspects of her gymnasium activities as this aggravated her symptoms. This improved over time.

Some of her injuries resolved by six weeks after the accident and all had resolved by three months.

Following the injury, the woman instructed a specialist personal injury solicitor to pursue a claim for compensation. The woman alleged that the defendant was negligent in not providing flooring suitable for the work they were doing.

Liability was admitted. An out of Court settlement was agreed in the sum of £3,695.
