Woman receives compensation following a fall downstairs

The claimant, a 27-year-old woman, received £50,000 total damages for the ankle, back and finger injuries she sustained following a fall down stairs at work in January 2017.

The woman sustained an ankle ligament injury and inflammation to tendons after she slipped on a wet floor whilst working as a bar assistant for the defendant employer and fell down a flight of stairs on 24 January 2017.

The injury she sustained was very debilitating. She suffered a soft tissue lateral ligament injury to her left ankle, injury to her lower back and bruising to her right middle finger leading to inflammation of the flexor tendons and flexor tenosynovitis. She required crutches for a period of time and underwent physiotherapy, facet joint injections and facet joint denervation.

The woman’s medical evidence suggested she might require lateral ligamentous reconstruction surgery. She would have permanent muscle weakness in her ankle.

She brought an action against her employer alleging that it was negligent in:

  1. causing or permitting her to walk across an area of floor when it was hazardous and slippery due to being wet;
  2. failing, after the stairs had been cleaned, to put a wet floor sign at the top of the stairs or to dry the stairs;
  3. failing to warn her of the wet stairs;
  4. failing to have sufficient wet floor signs in the premises;
  5. failing to provide safe access to the kitchen.

Liability was admitted and an out of court settlement was agreed in the sum of £50,000.
