Court of Protection Disputes

Sometimes, disputes about finances or welfare for people lacking capacity can come before the Court of Protection. Such proceedings are complicated and require detailed knowledge of the intricacies of the Court of Protection’s practice and procedure.

Biscoes can help and advise  with such proceedings, whether it relates to making an application to the Court that may cause a dispute with a family or to oppose an application that is not considered to be in the best interests of the individual concerned. We will actively try to negotiate an agreement or settlement to avoid the costs of litigation but are fully prepared to attend hearings before the Court of Protection should it be in the best interests of the client to do so.
