Whether an injury is the result of negligence or deliberate action, obtaining legal advice is the first step towards victims being justly compensated. In one case, a former soldier who was severely beaten by two non-commissioned officers (NCOs) won a seven-figure sum in damages from the Ministry of Defence (MoD).
The soldier was serving in Germany when he had a minor altercation with the NCOs in a nightclub. Following their return to barracks, they subjected him to a prolonged punishment beating, inflicting life-changing injuries. The NCOs were subsequently convicted of assault by a court martial and detained.
After the soldier's family instructed solicitors, the MoD admitted full liability for his injuries and agreed to pay him £1 million that will be used to fund his future care. In approving the settlement, the High Court paid tribute to his family for all that they had done for him and expressed the hope that the resolution of the case would enable him to put the unpleasant event behind him.
